By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, which constitute a legally binding agreement between you and Katundu.
Our platform is designed to revolutionize freight transportation across Zambia and neighboring countries by connecting shippers with qualified carriers, facilitating seamless logistics operations, and providing comprehensive supply chain visibility. These Terms outline the rules, obligations, and rights that apply to all users of our platform, whether you are a shipper seeking transportation services or a carrier providing them.

2. Definitions
Throughout these Terms, certain words and phrases have specific meanings. Understanding these definitions is crucial for interpreting your rights and obligations under this agreement.
"Platform"
Refers to Katundu's comprehensive digital freight network ecosystem, encompassing our web platform, mobile applications, APIs, and all related technology services that facilitate freight matching, tracking, documentation, and payment processing. The Platform includes all features, functionalities, and user interfaces provided by Katundu.
"Shipper"
Encompasses any individual, business entity, or organization that utilizes our Platform to arrange for the transportation of freight. This includes manufacturers, distributors, retailers, and other commercial entities that need to move goods. Shippers may be either the origin point of the freight or their authorized representatives.
"Carrier"
Refers to any motor carrier, transportation company, or logistics provider that has been verified and approved to provide freight transportation services through our Platform. This includes both individual owner-operators and larger fleet operations that have met our safety, insurance, and operational requirements.
"Freight"
Encompasses any goods, materials, commodities, or cargo that is transported or intended for transportation through our Platform. This includes various types of shipments ranging from palletized goods to full truckload cargo, subject to our acceptable use policies and legal restrictions.
3. Platform Services
3.1 Service Description
Katundu operates a sophisticated digital freight network that transforms traditional logistics operations through technology. Our Platform serves as a comprehensive marketplace and management system that brings efficiency, transparency, and reliability to freight transportation across Zambia and neighboring regions.
Through our Platform, we facilitate the entire freight transportation process, from initial booking to final delivery. This includes advanced freight matching algorithms that connect shippers with qualified carriers, real-time GPS tracking and visibility solutions, digital documentation management, secure payment processing, and comprehensive analytics tools for business intelligence.
Our services are designed to optimize the entire supply chain, reducing empty miles for carriers while ensuring reliable and cost-effective transportation solutions for shippers. We leverage data analytics and machine learning to continuously improve matching efficiency and provide valuable insights to all platform users.
3.2 Service Limitations
While we strive to provide the highest quality service, it's important to understand that Katundu operates as a technology platform facilitating connections between shippers and carriers. We do not own trucks or directly provide transportation services. Our role is to enable and optimize these connections through technology.
The availability of carriers and specific rates on our Platform is subject to market conditions, seasonal variations, and the current supply-demand balance in different regions. While we work to maintain a robust network of verified carriers, we cannot guarantee the availability of specific equipment types or rates at all times.
The accuracy of GPS tracking and estimated arrival times depends on various factors, including carrier compliance, network coverage, and external conditions. While we provide real-time updates, these should be considered approximate and may vary based on actual conditions.
Users acknowledge that the quality of transportation services ultimately depends on the performance of independent carriers. While we carefully vet our carrier network and maintain quality standards, we cannot directly control carrier operations or guarantee specific service levels beyond our platform's technological capabilities.
4. Freight Operations
4.1 Shipper Responsibilities
Shippers using our Platform assume specific responsibilities crucial for successful freight operations. First and foremost, shippers must provide accurate and complete information about their freight, including precise dimensions, weight, handling requirements, and any special characteristics that may affect transportation. This information is essential for proper carrier matching and pricing.
All freight must be properly packaged and labeled according to industry standards and applicable regulations. This includes appropriate containment for liquid goods, proper cushioning for fragile items, and clear hazard labels where required. Shippers are responsible for ensuring their freight complies with all applicable transportation laws and regulations.
Financial obligations include timely payment of agreed-upon rates and any additional charges that may arise from special handling requirements or service adjustments. Shippers must maintain appropriate insurance coverage for their freight and promptly report any issues or damages according to our claims procedures.
4.2 Carrier Responsibilities
Carriers on our Platform must maintain the highest standards of professional transportation services. This begins with maintaining all required licenses, permits, and certifications required by local and national transportation authorities. Carriers must ensure their equipment meets all safety standards and is suitable for the assigned freight.
Operational responsibilities include providing clean and well-maintained equipment, ensuring proper loading and load securement, maintaining required temperature controls for sensitive freight, and adhering to agreed-upon pickup and delivery schedules. Carriers must use our Platform's GPS tracking system throughout the journey and provide regular status updates.
Insurance requirements include maintaining comprehensive cargo insurance, public liability coverage, and any additional coverage required by law or specified in the shipping agreement. Carriers must promptly report any accidents, delays, or issues that may affect delivery through our Platform's communication channels.
4.3 Prohibited Items
To ensure safety and compliance with regulations, certain items are strictly prohibited from transportation through our Platform. This includes any illegal substances, contraband, or goods prohibited by local or international law. Hazardous materials may only be transported with proper documentation and by carriers specifically qualified for such transportation.
Live animals require special arrangements and can only be transported by carriers with appropriate equipment and permits. Perishable goods must be declared as such and can only be transported in properly equipped vehicles with temperature control capabilities.
The transportation of personal effects, household goods, or items of extraordinary value may be subject to additional restrictions or requirements. Users should consult our detailed prohibited items list and contact our support team with any questions about specific items.
5. Insurance and Liability
5.1 Insurance Requirements
Insurance coverage is a critical component of our freight operations. All carriers operating on our Platform must maintain comprehensive insurance coverage that meets or exceeds industry standards and regulatory requirements. This includes a minimum of $100,000 in cargo insurance to protect against loss or damage during transit.
Public liability insurance requirements align with national transportation regulations and must provide adequate coverage for potential accidents or incidents during freight transportation. Carriers must provide proof of current insurance coverage and promptly notify us of any changes in their insurance status.
For high-value shipments or specialized cargo, additional insurance coverage may be required. Shippers must accurately declare cargo values and any special insurance needs during the booking process. Failure to properly declare value may affect claim resolution in case of loss or damage.
5.2 Liability Limitations
As a technology platform, Katundu's liability is specifically limited to the performance and availability of our digital services. We maintain robust systems and security measures to ensure platform reliability and data protection. However, we cannot assume liability for the physical transportation of freight or the performance of individual carriers.
Our carrier verification process is designed to ensure all transporters meet basic safety and insurance requirements. However, we cannot guarantee the performance of individual carriers or prevent all potential issues that may arise during transportation. Claims for cargo loss or damage must be filed directly with the carrier's insurance provider according to our claims procedures.
Important Liability Notice
Katundu explicitly disclaims liability for carrier negligence, cargo damage, delivery delays, or any other issues arising from the physical transportation of freight. Our responsibility is limited to the technology services we provide through our Platform.
6. Payment Terms
6.1 Pricing and Fees
Our pricing structure is designed to provide transparency and fairness to all platform users. All rates are quoted in Zambian Kwacha (ZMW) and include our platform fee, which is calculated as a percentage of the total freight charges. This fee covers the cost of our technology services, payment processing, and platform maintenance.
Additional fees may apply for special services such as expedited delivery, special handling requirements, or after-hours operations. These fees will be clearly communicated during the booking process. Fuel surcharges may be implemented to account for significant fluctuations in fuel prices, with advance notice provided to all users.
Rate quotes are valid for the specific shipment parameters provided. Any changes to weight, dimensions, or service requirements may result in rate adjustments. Users are responsible for ensuring all shipment information is accurate to avoid unexpected charges.
6.2 Payment Processing
All financial transactions on our Platform must be processed through our secure payment system. This ensures proper tracking, documentation, and protection for both shippers and carriers. Payment terms for carriers are standardized to ensure consistent and reliable payment processing.
Carriers receive payment according to agreed-upon terms after successful delivery and submission of required documentation. Standard payment terms are 15 days from the date of delivery, though expedited payment options may be available for an additional fee.
Disputed charges must be reported through our Platform within 5 business days of the transaction. Our team will review all disputes promptly and work with both parties to resolve any issues. Late payment fees may be assessed on overdue accounts at a rate of 2% per month.
7. Data Privacy and Security
Protecting your data and privacy is fundamental to our operations. We employ industry-leading security measures and best practices to safeguard all information processed through our Platform. Our comprehensive data protection strategy includes multiple layers of security and regular audits to ensure compliance with international standards.
All sensitive data transmitted through our Platform is encrypted using advanced encryption protocols. This includes payment information, personal identification details, and proprietary business data. Our secure storage systems are designed with redundancy and disaster recovery capabilities to ensure data preservation and availability.
We maintain strict data sharing policies and only share information with verified partners when necessary for service delivery. All third-party integrations are thoroughly vetted and must meet our security requirements. 8. Dispute Resolution
8.1 Claims Process

All claims must be submitted through our Platform within 24 hours of delivery to ensure prompt investigation and resolution. This timeframe is critical for collecting necessary evidence and documentation while details are fresh and available.
Claims must include comprehensive documentation, including photographs of damage (if applicable), delivery receipts, and any other relevant evidence. Our claims team reviews all submissions within 5 business days and works with all parties to reach a fair resolution. The decision of our claims team is final and binding for all platform-related disputes.
8.2 Arbitration
In the event that a dispute cannot be resolved through our standard claims process, the matter will be referred to binding arbitration. All arbitration proceedings will be conducted in Lusaka, Zambia, under the rules and procedures of the Zambian Arbitration Association.
The arbitration process provides a fair and efficient means of resolving disputes without the need for costly litigation. Both parties agree to share arbitration costs equally unless otherwise determined by the arbitrator. The arbitrator's decision will be final and binding on all parties.
9. Changes to Terms
The logistics industry is dynamic, and our services continuously evolve to meet changing needs. We reserve the right to modify these Terms at any time to reflect changes in our services, legal requirements, or business practices. When we make material changes to these Terms, we will notify users through multiple channels to ensure awareness.
Notification methods include posting updated Terms on our website, sending email notifications to registered users, and displaying prominent notices in user dashboards. We encourage users to regularly review these Terms to stay informed about their rights and obligations.
